When my friend John became the executor for his Aunt Carol’s estate, he learned quickly that even a meticulous plan requires a steady hand to navigate the 757 court system. Here is the roadmap he followed to successfully settle her affairs.

The Initial Hurdle: Validation

The first step for John was ensuring the Will met the strict requirements of Virginia Code § 64.2-403. Discrepancies here don't just cause delays... they can invite legal challenges that stall the entire process before it starts.

1. Scheduling the Probate Appointment

John gathered the essentials: the original Will, a certified death certificate, and an asset estimate. Because John lived out of state, he also had to arrange for a Virginia resident agent to join him at the Virginia Beach Circuit Court.

2. Qualification & Legal Notice

Once qualified, John received his Certificates of Qualification—his "license" to act for the estate. He had exactly 30 days to notify all interested parties and file his Affidavit of Notice with the court. Timely communication is not just courtesy; it’s a legal requirement.

3. The Inventory Phase

John had four months to file a detailed inventory with the Commissioner of Accounts. This meant identifying every asset and determining its fair market value at the time of death. Meticulous record-keeping here is the only way to avoid personal liability later.

4. Settling Debts and Taxes

John was responsible for filing Aunt Carol’s final income tax returns and ensuring all debts were paid in the specific order of priority dictated by Virginia Code § 64.2-528. Paying the wrong creditor too early can be a costly mistake for an executor.

5. Final Distribution

Only after every debt, tax, and administrative fee was settled could John distribute the remaining legacy to the beneficiaries. Documentation of every transaction was vital to ensure transparency and court compliance.

John's Lessons Learned

Even with a valid Will, the process is an eye-opener. It reinforced that while probate can be daunting, having the right knowledge and local support makes all the difference.
